These Terms of Service (“Terms”) govern your use of the website and marketplace at www.trusteefarm.com (the “Platform”), operated by Trusteefarm Limited (“Trusteefarm”, “we”, “us”) of Accra, Ghana. By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. The Platform
Trusteefarm connects farmers and farming cooperatives (“Farmers”) with buyers, processors and exporters (“Buyers”). Through the Platform, Farmers can list produce and respond to sourcing requests, and Buyers can post sourcing requests, place orders, negotiate with Farmers and make payments. Trusteefarm facilitates these transactions, reviews participants and, where described on the Platform, verifies and holds payments in escrow. Unless we expressly state otherwise, the contract for the sale of produce is between the Farmer and the Buyer.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract to use the Platform.
- You must give accurate, current and complete information and keep it up to date.
- You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at info@trusteefarm.com if you suspect unauthorised use.
- If you register on behalf of a business or cooperative, you confirm that you are authorised to bind it to these Terms.
3. Farmers
- Farmer accounts and produce listings may be reviewed before they are approved. We may approve, reject, edit or remove listings at our discretion.
- Listings must accurately describe the produce, including variety, quantity, quality, grade, availability and price.
- Verification documents you submit must be genuine and belong to you or the business you represent.
- You must fulfil accepted orders as agreed and, where escrow applies, dispatch produce only after Trusteefarm confirms that payment has been secured.
- You are responsible for complying with laws that apply to your produce and business, including quality, safety and export requirements.
4. Buyers
- Sourcing requests and orders must be genuine and accurately describe what you need.
- You must pay for accepted orders using the payment methods offered on the Platform.
- Payment references you submit (for example a Mobile Money or bank transaction ID) must be accurate. Submitting false payment information is a serious breach of these Terms.
- You must use Farmer contact details received through the Platform only for legitimate trade with that Farmer.
5. Orders, payments and escrow
- Prices are shown in Ghana Cedis (GH₵) unless stated otherwise. Delivery fees, where applicable, are shown at checkout.
- Payment methods may include Mobile Money, bank transfer, card payments processed by Paystack, and Cash on Delivery where offered.
- Where escrow applies, the Buyer pays into Trusteefarm’s designated escrow account and submits the payment reference. Trusteefarm verifies the payment before the Farmer is asked to dispatch. A payment claim that cannot be verified may be declined, and the Buyer may be asked to resubmit correct details.
- Order prices and quantities may be changed only through offers that both parties accept on the Platform.
- If there is a problem with an order, such as non-delivery, wrong quantity or quality concerns, contact us promptly. We will work with both parties to resolve it, and may hold, release or return escrowed funds based on the information available to us.
6. Subscriptions and contact access
- Some features, such as unlocking Farmer contact details, may require a paid subscription or an approved contact-access request.
- Subscriptions run for the billing period you select (for example monthly or yearly) and include the features and contact limits shown at the time of purchase.
- Contact-access requests are reviewed by Trusteefarm and may be approved or declined at our discretion.
- For questions about subscription charges or refunds, contact us at info@trusteefarm.com. Refunds are handled in line with applicable law.
7. Acceptable use
You must not:
- provide false, misleading or fraudulent information, listings, orders or payment details;
- use the Platform to arrange transactions designed to avoid Trusteefarm’s review, escrow or fees where these apply;
- harass, threaten or abuse other users, or misuse their personal information;
- upload content that is unlawful, infringing or harmful, or that contains malware;
- attempt to access accounts, data or systems without authorisation, or interfere with the Platform’s operation or security;
- scrape, copy or resell Platform data without our written permission.
8. Content and intellectual property
You keep ownership of the content you submit, such as listings, photos and messages. You grant Trusteefarm a non-exclusive, royalty-free licence to host, display and use that content to operate and promote the Platform. The Trusteefarm name, logo, website design and software are owned by Trusteefarm Limited and may not be used without our permission.
9. Third-party services
The Platform relies on third-party services, including Google (sign-in and infrastructure), Paystack (payments) and email providers. Your use of those services may also be subject to their own terms and policies. We are not responsible for third-party services that we do not control.
10. Disclaimers
We work to review participants and keep the Platform reliable, but the Platform is provided on an “as is” and “as available” basis. Unless required by law, we do not guarantee the quality, safety or legality of produce listed by Farmers, the accuracy of information provided by users, or that the Platform will be uninterrupted or error-free. Farmer ratings, grades and verification badges are indicators to help you decide and are not a guarantee.
11. Limitation of liability
To the fullest extent permitted by law, Trusteefarm will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue or data, arising from your use of the Platform or from transactions between users. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of Ghana.
12. Suspension and termination
We may suspend or close an account, or remove content, if we reasonably believe that a user has breached these Terms, provided false information, or put other users or the Platform at risk. You may close your account at any time by contacting us. Provisions that by their nature should continue after termination, including those on payments, liability and governing law, will continue to apply.
13. Governing law
These Terms are governed by the laws of the Republic of Ghana. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Ghana.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date. If you continue to use the Platform after changes take effect, you accept the updated Terms.
